These Terms of Service ("Terms") form a legally binding agreement between you and Binary Leap OÜ ("ARK256", "we", "us", or "our"), a company registered in Estonia (Harju maakond, Tallinn, Lasnamäe linnaosa, Sepapaja tn 6, 15551, Estonia). These Terms govern your access to and use of the ARK256 service, including the website and all related services (collectively, the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Service.
"Vault" means an isolated, encrypted storage instance provisioned for you through the Service. "Vault ID" means the identifier issued when your vault is created. "Secret Key" means the credential you generate and control, used together with your Vault ID to access your vault. "Customer Data" means all files and content you encrypt and store through the Service.
The Service has no accounts. Access is by Vault ID and Secret Key only. You are solely responsible for safeguarding your Secret Key. Because the Service is zero-knowledge, we never receive your Secret Key or encryption key and cannot recover them. If you lose your credentials, your vault and its contents are permanently inaccessible, and we cannot restore access. You are responsible for all activity conducted with your credentials.
ARK256 is a zero-knowledge encrypted file storage service. Files are encrypted on your device before upload, stored as encrypted data we cannot read, and automatically relocated across regions on a recurring interval. Access is performed using token-based credentials, with no account, email, or password required.
The Service is offered under monthly plans (Ghost and Phantom) and a one-time (30-day) plan. Current pricing is published at ark256.com. All payments are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all transactions. By purchasing a plan, you agree to Paddle's terms in addition to these Terms. Monthly plans are billed in advance. One-time plans are billed once for a fixed 30-day term. All fees are non-refundable except as set out in our Refund Policy. You are responsible for any applicable taxes, which Paddle calculates and collects on our behalf. We may modify pricing on 30 days notice, with changes taking effect at your next billing cycle.
When your payment is processed, we provision a dedicated, encrypted vault for you. For Phantom plans, your data is distributed across multiple dedicated instances in different regions. Provisioning occurs before any files are uploaded. If provisioning fails due to an error on our side, you will not be charged for the failed vault.
You retain all rights, title, and interest in your Customer Data. We do not claim ownership of it. Because your files are encrypted on your device with a key we never receive, we cannot read, use, or disclose the contents of your Customer Data. We process it only as encrypted data, to store it, relocate it during rotation, and return it to you. We do not sell, rent, or share your Customer Data.
Each vault runs on its own dedicated, isolated instance and is not accessible by other users. Your data is never placed in a shared pool or stored alongside data from other customers: there are no shared tables, no shared storage, and no row-level filtering separating customers. Isolation is physical, at the instance level. As a core function of the Service, your encrypted vault is automatically relocated between regions, which may include regions outside the European Economic Area. Only encrypted data that we cannot decrypt is ever transferred. Further detail is set out in our Privacy Policy.
All connections to the Service are encrypted with TLS. Files are encrypted on your device with AES-256 before upload. We store only a hash of your secret, never the secret or your key. We apply rate limiting and brute-force protection, and backups are encrypted at rest. While we implement commercially reasonable security measures, no system is completely secure, and you are responsible for safeguarding your credentials.
We will use commercially reasonable efforts to make the Service available, but we do not guarantee any specific level of uptime. The Service may be temporarily unavailable due to maintenance, infrastructure changes, or circumstances beyond our reasonable control.
You agree not to use the Service to: (a) violate any applicable law, regulation, or third-party rights; (b) store or transmit content that is unlawful or that you have no right to store; (c) attempt to gain unauthorized access to any part of the Service or other vaults; (d) interfere with or disrupt the integrity or performance of the Service; (e) reverse engineer, decompile, or attempt to derive the source code of the Service; (f) use the Service to build a competing product; or (g) exceed the storage or usage limits of your plan.
We may suspend or terminate access to the Service if you violate these Terms or the Acceptable Use section, if your use poses a security risk to the Service or others, if you fail to pay applicable fees, or if required by law. You may stop using the Service at any time. On termination or expiry of a plan, your vault and all associated data, including backups and copies, are permanently destroyed. Because of the zero-knowledge design, destroyed data cannot be recovered.
For monthly plans, your vault is retained while your subscription is active and destroyed at the end of the billing period following cancellation. For one-time plans, all servers, data, and copies are permanently destroyed after the 30-day term. We do not retain a recoverable copy of your encrypted data after destruction.
The Service, including all software, interfaces, and trademarks, is the property of Binary Leap OÜ and is protected by applicable intellectual property laws. These Terms grant you only a limited right to use the Service in accordance with these Terms. "ARK256" and associated logos are trademarks of Binary Leap OÜ and may not be used without our prior written consent.
To the maximum extent permitted by applicable law, in no event shall Binary Leap OÜ, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, resulting from: (a) your access to or use of, or inability to use, the Service; (b) any unauthorized access to or alteration of your data; (c) loss of access caused by lost credentials; or (d) any other matter relating to the Service. Our total aggregate liability arising out of or in connection with these Terms or the Service shall not exceed the greater of (i) the total fees you paid us in the twelve (12) months preceding the event giving rise to the claim, or (ii) one hundred euros (EUR 100).
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
You agree to indemnify, defend, and hold harmless Binary Leap OÜ and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law; (d) your violation of the rights of a third party; or (e) any Customer Data you store or process through the Service.
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page with a revised effective date. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service.
These Terms are governed by the laws of the Republic of Estonia, without regard to its conflict of laws provisions. Any disputes shall be resolved by the courts of Harju County, Estonia. Before initiating formal proceedings, you agree to attempt to resolve any dispute by contacting us at bl@binaryleap.eu, and we will attempt to resolve it through good faith negotiation within 60 days.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Binary Leap OÜ regarding the Service. You may not assign or transfer these Terms without our prior written consent.
